Apple facing a class action lawsuit

South Carolina residents may have heard about a class action lawsuit recently filed against Apple. The suit claims that the company should be held liable for some automobile crashes that were caused by distracted drivers. Specifically, it claims that some drivers were distracted because they were texting or using iPhone apps while driving. The plaintiffs ask that Apple be barred from selling the iPhone 6 in California until it adds a safety lock feature.

The company reportedly designed such a feature in 2008 and got a patent for it in 2014. However, it was never installed in Apple's phones. The lead plaintiff in the suit was hit at a stoplight by a vehicle that was driven by an individual who was using an iPhone. According to the U.S. Department of Transportation, there are as many as 1.5 million people texting and driving at any given time.

While states may have laws against distracted driving, they aren't always easy to enforce. Officers may not see a person texting or using a cell phone while driving, and many drivers will deny using a phone illegally when asked by the police. Lots of officers simply take drivers at their word because it is difficult to get a warrant to search a phone.

Those who are hurt in a car accident may wish to talk with a personal injury attorney. A lawyer might be able to show that the driver who caused the crash acted in a negligent manner. This may be done by pointing to phone records that indicate that the negligent motorist was texting or using an application just prior to the accident. If successful, an injured victim might be entitled to compensation.
