Motorcyclists at high risk of injury and death

South Carolina has a partial helmet law, which requires helmet use for motorcycle riders 20 and younger. Wearing a helmet improves the chances of surviving a motorcycle accident. In terms of preventing fatal injuries, helmets are 37 percent effective in limiting fatalities for motorcycle drivers and 41 percent effective for their passengers.

Nationwide in 2012, there were 4,957 fatalities and 93,000 injuries involving motorcycle riders. During 2012, when there were about 8.5 million of the vehicles on the road, motorcyclists were nearly 26 times more likely to die and five times more likely to be injured in an accident compared to car occupants. Even if riders are wearing helmets, when a motorcycle is involved in a car accident, motorcycle riders are more vulnerable than the enclosed vehicle occupants are. Some risk factors for motorcycle-versus-auto accidents are the skills and alertness of the drivers, speed, road conditions, the mechanical condition of the vehicles and whether the motorcycle is visible to the other drivers.

As the number of older motorcyclists has increased from 2003 to 2012, the number of individuals who are age 40 and over and who are were killed in crashes increased by 63 percent. Concurrently, deaths among young motorcyclists involved in crashes declined. It has been suggested that older drivers are more vulnerable in an accident due to their increased fragility, which makes them prone to more serious accident injuries. Although injury rates for all ages are rising, those who are age 60 and over are more likely to sustain serious injuries than those in the youngest group.

When a motorcycle is involved in a crash and there are serious injuries or fatalities, a lawyer could help by examining the police report and other documentation regarding the accident. A lawyer could represent accident victims in dealings with insurance and the party that allegedly caused the accident during negotiations or in court.
