Woman killed after being struck by vehicle

The South Carolina Highway Patrol reported that a pedestrian was struck and killed while walking alongside Interstate 385 on Oct. 9. According to investigators, the 25-year-old woman was walking in an attempt to flag down a vehicle to help with an accident that had previously occurred on the interstate.

The fatal pedestrian accident happened around 10:30 p.m. when a sedan struck the woman. Emergency personnel pronounced her dead at the scene. A second vehicle, an SUV, then swerved in an apparent attempt to avoid the accident, striking the median. There was no word in the report on whether either of the other involved drivers suffered any injuries in the accident.

People driving on South Carolina's roads have a duty to keep aware of their surroundings while driving. If a driver is distracted and causes an accident that results in the death of another person, the driver may be subject to civil liability for his or her negligence in causing the wrongful death.

Many people are killed in car and pedestrian accidents each year. The families or estates of victims may wish to consult with a personal injury attorney who practices in wrongful death cases. He or she may be able to evaluate the individual facts of a case to determine all possible claims and recoverable damages. Families may be able to recover for damages such as funeral and medical expenses, loss of consortium, pain and suffering and loss of inheritance. Families are also able to recover punitive damages in cases in which they are warranted.
