Pedestrian accident takes life of Greenville woman

All traffic accidents have the potential to be fatal, but pedestrians face greater risks because of their vulnerability and lack of protection. Pedestrians in Greenville are threatened by negligent, impaired or distracted drivers. Defective property and traffic safety devices may also lead to a pedestrian accident.

A pedestrian was killed every two hours and injured every eight minutes in traffic crashes in 2010 according to the National Highway Transportation Safety Administration. The NHTSA found that there are almost 5,000 pedestrian fatalities and more than 78,000 injuries annually caused by a vehicle.

A hit-and-run accident led to the death of a 40-year-old Greenville woman on U.S. Highway 25 near the intersection of state Highway 81, according to the South Carolina State Police. The victim was walking home to a nearby mobile home park at 1 a.m. at the time of the accident. The driver did not stop, but police found evidence at the accident indicating that the vehicle is a late-model, two-door Nissan with a rear spoiler. It is possibly maroon and has damage to its front end and undercarriage.

Regardless of sidewalks, street signs and other protections, pedestrians may be at risk if a driver is distracted, impaired, or does not comply with traffic laws. The harm may be further compounded if a driver fails to stop and render assistance when a pedestrian is hit by a car. Pedestrian accident victims may be entitled to compensation if a driver is at fault for an accident. Police investigations can provide evidence that may help a victim make the case, but must be completed promptly because time periods govern the filing of a legal action and it is important to secure evidence.

A personal injury lawsuit could provide for medical expenses, lost wages and pain and suffering, among other losses. A pedestrian accident victim's family may also seek damages in a wrongful death action for the loss of a relative.
